Privacy Policy

1. Introduction

Your privacy is important to us, FABSY, LLC (FABSY, we or us). This Privacy Policy outlines how your information is collected, used and disclosed when you access or use our Services.

This Privacy Policy is incorporated by reference into our Terms. Any capitalized terms not defined in this Policy are defined in the Terms. You agree to comply with all Terms when accessing or using our Services, including this Privacy Policy.

2. What information do we collect and how is it collected?

We only collect information that you provide to us via use of our Services as well as through any other means used to contact us.

The kinds of Personal Information we collect include your contact information such as your name, email address, organization, address and phone or mobile number.
We reserve the right to maintain, store and use any information or data where we reasonably believe that such action is required to comply with any legal or regulatory obligations, to prevent criminal or other unlawful activity whether immediate or in the future, or where we have a legitimate business reason to do so, including collection of amounts owed, resolving disputes, enforcing our Terms or for record keeping integrity.

You expressly consent to the use of your Personal Information for the provision of Services in accordance with our Terms. When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information about an identifiable individual as “Personal Information”. 

3. Minors

The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us through our Contact form to request deletion.

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you. For example:

5. Third party Websites and Social Media

Our Services may, from time to time, contain links to and from Websites which are owned or operated by other parties or use services of third parties, including Google, Instagram, Facebook, and Pinterest. You acknowledge and agree that FABSY has no control over, and shall not be liable for, the privacy practices or content of these third party Websites and FABSY does not make any representation about the privacy practices of, any third-party Websites, whether or not linked from or transferred from our Services. You are responsible for checking the Privacy Policy of any such Websites and applications so that you can be informed of how they will handle Personal Information.
We run pages on a number of social media platforms, including Instagram, Facebook, Pinterest and Google Plus (Social Media Platforms). By accessing, interacting with and using our social media pages, you agree to the terms and Privacy Policy of those Social Media Platforms. You acknowledge and agree that these Social Media Platforms may collect your information and that the privacy practices of those Social Media Platforms are not controlled by us and that we hold no responsibility for such privacy practices.
We may from time to time, have access to statistics regarding the number of views, navigation patterns, posts that you like, comment on or share and any user interactions with our social media pages and may use such information for the purpose of its marketing and promotion strategies.

6. Using Personal Information

We use your personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services, and offers.

7. Lawful basis

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your personal information under the following lawful bases:

  • Your consent;
  • The performance of the contract between you and the Site;
  • Compliance with our legal obligations;
  • To protect your vital interests;
  • To perform a task carried out in the public interest;
  • For our legitimate interests, which do not override your fundamental rights and freedoms.

8. Retention

We take reasonable steps to protect your Personal Information in accordance with this Privacy Policy. When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information. 9. Automatic decision-making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a small number of hours.
  • Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a small number of days.

10. Your rights

10.1 GDPR

If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. If you would like to exercise these rights, please contact us through our Contact form. 

Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. 10.2 CCPA

If you are a resident of California, you have the right to access the Personal Information we hold about you (also known as the ‘Right to Know’), to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. 11. Cookies

A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. Our Services may use cookies to identify a user who engages with our Services and to compile records of a user’s history of engaging with our Services. We use a number of different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the website to remember your actions and preferences (such as login and region selection). This means you don’t have to re-enter this information each time you return to the site or browse from one page to another.

The length of time that a cookie remains on your computer or mobile device depends on whether it is a “persistent” or “session” cookie. Most of the cookies we use are persistent and will expire between 30 minutes and two years from the date they are downloaded to your device.

12. Do Not Track

Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
